Terms of Use

These terms govern your use of www.clms.cc (the “site”), the marketing website for CLMS Cloud, operated by ES Vision, Malaysia (“ES Vision”, “we”, “us”). By using the site you accept them. If you do not accept them, please do not use the site.

These terms cover the website only. Using the CLMS Cloud service itself — a trial workspace, a paid subscription or a White Label OEM deployment — is governed by the separate agreement we provide before your workspace is created. Where the two differ, that agreement prevails for the service.

1. What the site is for

The site describes CLMS Cloud, publishes indicative pricing, and lets you contact us or ask for a trial. It is intended for businesses. Nothing here is legal, financial, regulatory or licensing advice. Whether a lending business may operate, and under what licence, is a matter for you and your own advisers — we describe what our software does, not what your regulator requires of you.

2. Pricing shown on the site

Plan prices are quoted in US dollars. Where the site shows an amount in your local currency, that figure is indicative only: it is converted using a rate we set manually and refresh periodically, it is not a live market rate, and it is not an offer at that amount. The USD figure shown beneath it is the one that governs. Prices, plan limits and included features may change; the binding price is the one stated in the order or subscription you actually enter into. White Label OEM is quoted per project and no list price is offered.

3. Acceptable use

You may read, print and share these pages for your own business evaluation. You may not:

• scrape, harvest or bulk-download the site, or use automated means to submit our forms;
• attempt to gain unauthorised access to the site, its server or any connected system, or probe or test its security without our written permission;
• interfere with the site’s operation or availability;
• copy the site’s design, text or images to present them as your own or as another product’s;
• use the site or our contact channels to send unlawful, misleading, infringing or abusive content.

4. Information you send us

When you use the contact form, the sign-up form or our WhatsApp link, you confirm that the information you give is accurate and that you are entitled to give it. If you send us personal data about anyone else — a colleague, for example — you confirm you may lawfully do so. How we handle what you send is set out in our Privacy Policy.

Do not send us passwords, customer records, identity documents or other sensitive material through these channels. They are ordinary business contact channels, not a secure transfer facility.

5. Intellectual property

The CLMS Cloud name, logo, page text, layout and screenshots are owned by ES Vision or used under licence, and are protected by copyright and trade mark law. Using the site gives you no licence to them beyond reading the pages. Product, company and regulator names belonging to others are used for identification only and remain their owners’ property.

6. Availability and accuracy

We try to keep the site accurate and available, but we do not promise either. Pages may be incomplete, out of date, or offline for maintenance or reasons outside our control. Feature descriptions reflect the product as we understand it at the date shown below; the roadmap may change and a feature described here is not a contractual commitment until it appears in your agreement.

7. Links to other sites

The site links to services we do not control, including WhatsApp and our own application at app.clms.cc. We are not responsible for other operators’ content or practices, and their own terms and privacy policies apply when you use them.

8. Liability

To the fullest extent the law allows, the site is provided “as is” and we exclude all warranties not expressly given here. We are not liable for indirect or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings, arising from your use of the site or reliance on anything published on it. Nothing in these terms limits liability that cannot lawfully be limited — including liability for fraud, or for death or personal injury caused by negligence.

9. Changes

We may update these terms. The version published here, with the date at the foot of the page, is the one that applies. Continuing to use the site after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have non-exclusive jurisdiction over any dispute arising from them or from your use of the site.
